State of investigation of protection of rights of scientifically pedagogical workers on objects of intellectual property as administrative problem of pedagogical science and practice in the conditions of the developed informational environment

Abstract


 

 

Introduction. Social transformations which take place in Ukraine pull out new tasks before the system of education and need introduction in the pedagogical process of higher educational establishments of new educational technologies, creative use of results of scientifically pedagogical researches, subsequent professional perfection of professional activity of scientifically pedagogical workers. At legislative level priority directions and basic ways of reformation of higher education in accordance with the necessities of society and state are represented. The primary purpose of activity of higher educational establishments is conditioning for the development of personality, providing of necessities of society and state in qualified competitive specialists.

Strategic direction of educational industry reformation is formation of modern skilled potential, teacher of new generation, which is apt at realization of educational policy of the state. The efficiency of innovations depends directly on the system of its introductions and management.

Purpose. To analyse the condition of protection of rights of scientifically pedagogical workers on objects of intellectual property as administrative problem of pedagogical science and practice in the conditions of the developed informational environment.

Methods. The methods of theoretical analysis and syntheses are used.

Results. The main factor of the development in XXI century becomes the accumulation of material welfares, knowledge, experience, abilities, intellectual potential, which is all together forms a human capital.

Nowadays in Ukraine the role and importance of the intellectual property intensively increases. The society comes to understanding that such property is the most valuable for mankind. Protection of intellectual property for many countries of the world is one of priority directions of public policy. Main reasons of necessity of protection of rights on the objects of intellectual property at state level is an assistance innovative development of the state, which is pre-condition of the economy growing, increase of creative potential of society.

Our independent state creates the own mechanisms of defence of copyrights, industrial ownership, moral and financial interests which arise up in connection with the different types of intellectual activity rights consistently. The necessary element of socio-economic progress of the state is a presence of modern, acknowledged at an international level, systems of protection of rights on the objects of intellectual property.

The legal management of any organization, which is directed on providing of competitiveness, must search innovative suggestions, and strategy of its development is built taking into account the reliable guard of intellectual ownership rights as to one of factors of future success. The use of intellectual property in activity of organization from point of economy is its commercialization, that intellectual property examines as a commodity, and as a capital the formation of which needs system administrative influence.

An intellectual capital is knowledge of all workers of organization, which provide its competitive edges (ideas, developments, projects, technologies, methods, relations, with the users of services, database). Except knowledge and information to intellectual capital relates an infrastructure, which provides their use, transmission and maintainance.

Originality. Nowadays an industrial economy give place to intellectual and informative economy, innovative development for which scientific and technical information becomes a commodity and article of contractual relations, and creative thought has the same value, as well as professional training.

Conclusion. It is substantiated and well-proven that legal defense of Ukrainian citizens in any industry of their productive activity is one of the important directions of state activity, which carries duties to create conditions for complete realization by the citizens of their right to work, guarantees equal possibilities in the choice of profession and labor activity, will realize the programs of education, training of personnel in accordance with public necessities.
